Are you interested in building an exciting career protecting North Carolina investors? Are you interested in investigating and litigating complex administrative and/or criminal cases that may include crypto/digital assets, precious metals, securities compliance, registration of securities products and securities professionals?

The North Carolina Department of the Secretary of State, Securities Division mission is to protect North Carolina investors. Consistent with that purpose, the Securities Division seeks to ensure a free and competitive securities market in North Carolina and increase investor confidence in the securities industry through education outreach, compliance and enforcement actions.

The Securities Division is seeking an Attorney II to advise and litigate cases within our Enforcement Section. The position requires an experienced attorney to investigate and enforce the North Carolina Securities Act (N.C.G.S. Chapter 78A), the North Carolina Investment Advisers Act, including the Uniform Athlete Agents Act (N.C.G.S. Chapter 78C), the North Carolina Commodities Act (N.C.G.S. Chapter 78D) or other statutes under the authority of the North Carolina Secretary of State. This attorney works independently and must be able to conduct and manage investigations through litigation and post-trial sanctions. The major functions of this position involve administrative hearings, criminal prosecution, trial litigation, pre-trial and trial responsibilities, as well as administrative rule-making duties. This attorney may act as a liaison on securities administrative issues with other state regulators, attorneys, and industry leaders.
  • Attorneys with experience in banking, insurance, compliance or consumer protection litigation are encouraged to apply.
  • This position may require occasional in-state and out-of-state travel for court appearances, training, seminars or conferences.
  • No salary will be offered above the recruitment range: $70,732.00 - $94,500.00. Salary determination is based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.
  • This position may be eligible for an alternate worksite arrangement in accordance with the Secretary of State's Teleworking Policy, but must permanently reside within 50 miles from the Securities Division office in Raleigh, North Carolina.
Knowledge, Skills and Abilities / Competencies

Qualified applicants must document on the application that they possess all of the following:
  • Working knowledge of judicial and quasi-judicial procedures and the rules of evidence.
  • Knowledge of and the ability to interpret and apply provisions of the Federal Securities laws and the North Carolina Securities, Investment Adviser, Commodities Acts and their related administrative regulations.
  • Experience in timely responding to internal requests and external inquiries via written and oral communication in a clear and concise manner.
  • Experience prioritizing tasks and ensuring timely compliance with timekeeping obligations and case reporting requirements.
  • Experience independently litigating complex administrative, civil and/or criminal cases.
  • Experience conducting research and draft memorandum, pleadings, opinions, legislation or rules in a clear and precise language.
  • Experience analyzing facts, evidence, investigative reports, accounting or business records in order to identify fraud or other violations.
Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
